Accommodating Children with Disabilities

The Ontario Human Rights Commission released a new policy on “Accessible Education for Students with Disabilities” on August 29, 2018 regarding accessible education for children with disabilities. Under the Code, education providers including child cares, private and public organizations have a legal duty to accommodate the needs of students with disabilities to the point of undue hardship.

This training session will discuss what these legal obligations mean for child care organizations including:

• Duty to accommodate

• What constitutes a disability?

• When is the duty to accommodate triggered?

• How to deal with challenging behaviours

• Dealing with difficult parents

This session will be facilitated online via Zoom and you will receive a link the day before the session takes place.

About the Presenter:

Asha Rampersad Lawyer and HR Advisor Bernardi Human Resource Law LLP Asha has represented major crown corporations, municipalities and large private sector clients on a broad range of labour and employment matters, including human rights litigation; grievance arbitrations; AODA and human rights compliance; employment litigation and occupational health and safety issues. Asha is also a seasoned litigator who has successfully litigated cases before the Human Rights Tribunal, the Ontario Labour Relations Board, and private boards of arbitration.

Asha is a highly sought after speaker who has been selected to speak at a number of employment and labour conferences across Canada and has significant expertise in the practice areas of disability management, human rights and accommodation issues and advising employers on all facets of labour and employment law. She has also been part of the faculty for the Osgoode PD Mental Health and Labour Certificate Programs. Asha has been quoted in the Law Times regarding an employer’s Duty to Investigate, and has been published extensively in various newsletters and magazines, including Profitable Practice, the Ontario Bar Association, Labour & Employment section, Echo Newsletter (OMHRA), Mondaq, HRM Canada and the Accessibility News regarding employer’s AODA obligations.
