Those involved in the construction industry are continually faced with financial risks due to payment delays as construction trades people often do work on a project without any form of security. This is especially true for subcontractors who have no direct contract with the owner.
As a result of these risks, contractors and suppliers of services and supplies to real property in Ontario have been granted special protections by the Construction Lien Act (the "CLA"). The CLA can be credited with facilitating the expeditious and inexpensive resolution of many construction disputes.
This seminar will cover the rules under the CLA, who is able to lien a property as security for payment and the process by which lien claimants can enforce their rights. The seminar will also cover your rights as a contractor or subcontractor to bring an action for payment, holdback requirements, time limits for a claim for lien and reasons to vacate the lien.
