Productivity goes to zero, the threat of reputational damage looms large, as does the potential for adverse litigation. In fact, 60% of small businesses will fail within six months of a cyber attack.

The firm’s Data, Cybersecurity and Privacy Group—Incident Response centers on immediate and comprehensive response to data loss events. Through this approach, Siskinds concentrates on determining the scope of the data loss through forensics, providing advice on legal issues including notification to affected customers and governmental entities, managing public relations, analyzing data/document handling and retention compliance, as well as managing appropriate customer remedies, litigation hold/e-discovery requirements, indemnity shifting analysis, and class action litigation issues. Specifically, the firm serves as a “Breach Coach” or privacy counsel and uses a pool of third-party professional service providers who have the capabilities and experience to help organizations and businesses execute an effective data event response. In this role, Siskinds provides data event consultation services and assists insureds by directing the vendors needed to address a data event including computer forensics providers, print notification and call center providers, public relations and crisis communication providers, fraud consultants, and credit monitoring and identity restoration providers.

Drew is an associate in Siskinds’ Data, Cybersecurity and Privacy Group. His practice focuses on providing legal services to businesses involved in the technology industry relating to IP and data transfer, development, distribution and licensing. He advises clients in all sectors on matters relating to cybersecurity, data protection, privacy, data breach coaching, and anti-spam, including PIPEDA, Privacy Shield and GDPR compliance.
