Redemption for Corporate Crimes:

Do Deferred Prosecution Agreements Make Sense?

Deferred Prosecution Agreements (DPAs) have gained increasing visibility and prominence in the international fight against corporate corruption, according to a 2017 study by Transparency International Canada. In 2018, Canada became the latest country to legislate ( after the USA and the UK) an additional tool to fight economic crimes.

The possibility of a Canadian DPA or ‘remediation agreement’ between the government of Canada and SNC/Lavalin over corrupt practices swiftly got entangled in domestic Canadian politics. Opponents mistakenly suggested that such agreements let corporate offenders off without penalty.

This lecture will explore the value of DPAs which have increasingly become a new option for prosecutors. It will examine what obligations company offenders have to meet as well as some of the thorny issues that have been raised about the appropriateness of public benefit and national economic interest in applying DPAs. Is there any way to decouple politics and such types of decision-making?
