Developing a Workplace Policy for Legal Marijuana

Legalized marijuana, both for medical and recreational use, is coming soon to a workplace near you. In the absence of an accepted impairment test for marijuana equivalent to the .08 breathalyzer standard for alcohol, employers and unions will be entering uncharted territory. Marijuana may show up in a urine or blood sample weeks after ingestion and its presence does not necessarily indicate impairment. How will employer policies reflect the legalization of marijuana? What are the responsibilities of unions in balancing the off-duty rights of their members with helping to ensure safe workplaces?

At this early stage, it is important for the parties to identify the various ways that the use of medical and recreational marijuana affects the employment relationship. Dr. Perry Sirota will discuss the emerging workplace psychological issues prompted by medical and recreational marijuana. From a legal position, Kevin Wilson will outline the emerging concerns, responsibilities, and liabilities of employers. Lisa Olson will share her experience with developing policy for safety sensitive (sworn police officers) and civilian staff.

Panelist Biographies:

Dr. Perry Sirota is a clinical and forensic psychologist with 30 years of experience. His clinical practice covers many areas of assessment, psychotherapy and crisis intervention. He provides general and customizable training and workshops that are generally but not exclusively geared to the Canadian and American workplace, including the following subjects; accommodation mental disabilities, mental health in the workplace, creating a safe and healthy workplace, drug and alcohol management, drug and alcohol policy development, threats, risk and violence, and diagnostic challenges including understanding the DSM-5.

Kevin Wilson, Q.C. is a Saskatoon based lawyer with MLT Aikins. He has practiced almost exclusively in the area of management side labour and employment law since 1989 for both unionized and non-union clients. He provides strategic and legal advice to employers in Saskatchewan. In addition, Kevin regularly appears before the Saskatchewan Labour Relations Board, courts, arbitration boards and other administrative tribunals on behalf of employers.

Lisa Olson is the Director of Human Resources at the Saskatoon Police Service. She has been an HR practitioner for over 20 years and currently oversees all aspects of Employment, Training, Organizational Development and Occupational Health and Safety. She obtained a Bachelor of Commerce from the University of Saskatchewan and has received her Diploma in Strategic Human Resource Management for Police Organizations from Dalhousie University and the Labour-Management Relations Certificate from the Edwards School of Business (U of S). She is currently enrolled in the Advanced Human Resources Program at Queen’s University. Over the years, Lisa has played a leadership role in the development of a number of progressive HR programs and policies.
