Do your inspection activities have the potential of leading down a road of an investigation where Provincial or Criminal Charges could be laid?

Knowing when a regulatory action makes the shift from an inspection to an investigation leadding to criminal or quasi-criminal action is a critical success factor for inspectors, auditors, compliance, and enforcement personnel.

This in-depth seminar starts with a brief explanation as to why it matters and is followed by a discussion of the relevant sections of our Constitution. One can understand that The Courts have taken this concept seriously and have gone as far as providing guidelines as to when a regulatory enquiry turns into a criminal investigation – in other words, when the Rubicon has been crossed! These guidelines will be discussed extensively along with relevant case law. This course goes further in that it explains the pitfalls of wearing both the inspector and investigator hats and details where we stand today.
