Even with effective and proactive planning, litigation is an unfortunate reality of doing business. Whether your business needs to sue another to enforce your rights, or are on the receiving end of a Claim, litigation can be costly. Having a solid sense of your legal rights, and business goals, at an early stage can be the difference between successful litigation and a costly mistake.

In this session participants will learn:

  • How to proactively manage your documents to save on legal fees during litigation;
  • How the Limitations Act sets limits on how long you have to sue;
  • How to use Ontario’s legal costs regime to your advantage;
  • The differences between various business structures (sole proprietorship, partnership, or corporation) during the litigation process;
  • Some tricks on getting the most out of legal advice during litigation, while limiting your legal fees.

Speaker:
Craig O’Brien is a partner at Nelligan O’Brien Payne and is the leader of the Commercial Litigation and Business Law Practice Groups. Craig works exclusively in civil litigation, with an emphasis on commercial and construction litigation, and professional liability litigation and business law.
