Jim is the Principal of James Zack Consulting, LLC a construction claims consultancy and the Senior Advisor, Founder and former Executive Director of the Navigant Construction Forum™. The Forum strives to be the construction industry’s resource for thought leadership and best practices on avoidance and resolution of construction project disputes globally. Formerly he was the Executive Director, Corporate Claims Management Group, Fluor Corporation, one of the world’s largest EPCM contractors. Mr. Zack was previously Vice President of PinnacleOne and the Executive Director of the PinnacleOne Institute and a Senior Construction Claims Consultant for CH2M HILL, Inc. Mr. Zack has, for 45 years, worked on both private and public projects throughout the U.S. and in 28 countries abroad. He has worked for both contractors and owners on more than 5,000 claims in his career. Mr. Zack is a Fellow of AACE, the Royal Institution of Chartered Surveyors and the International Guild of Project Controls. In the construction claims field, he is a recognized and published expert in mitigation, analysis and resolution or defense of construction claims and disputes. Mr. Zack is a Certified Construction Manager (CCM), a Certified Forensic Claims Consultant (CFCC) and a Project Management Professional (PMP).



Seminar Description:

This one day course includes a discussion of change orders – why the Changes clause is necessary; the cause and identification of changes; and how to keep changes from becoming claims or disputes. The course also covers the “universe of construction claims” from the perspective of both owners and contractors. The course provides a definition of the term “claim”; how and why construction claims arise; and then discusses the eleven types of construction claims included in most contracts including –

The course also includes a discussion of the burden of proof necessary to recover claim damages; claim damages quantum and claim analysis; various project delivery methods and how claims and disputes may arise under any contract form; and claims and dispute resolution methods.

This seminar will help attendees:

• Understand the burden of proof imposed on all claimants (both owners and contractors);
• Learn the basics of all 11 types of claims;
• Be exposed to what must be proven and documented for each type of claim;
• Become familiar with the analysis of construction claims;
• Learn about preparation of and/or analysis concerning claims damages; and,
• Gain insight into ways to resolve claims.


Course Objective:

The objective of this one day course is to provide information for both owners and contractors concerning entitlement, causation and damages for each of the basic types of claims. Attendees will learn how to prepare valid claims and/or defend against non-meritorious claims. The overall purpose of the presentation is to help identify how to manage construction claims on the project site – and not in the courtroom years later.
