The Alberta Construction Association (ACA) in partnership with the Red Deer Construction Association (RDCA) is hosting a Workshop for participants to understand the meaning of non-standard contract clauses and to explore the risks contractors are assuming and the consequent considerations when bidding. Unfair allocation of risk often times gets assigned in contract clauses based on project owners’ or their lawyers’ past experiences. When there is a lack of understanding of the risk, and the risk materializes, the bidder can jeopardize their business and disputes can arise.

The results arising from this Workshop will assist you to reduce your risks in responding to tenders containing non-standard terms. Your input will also assist ACA and Local Construction Associations to present in discussions and advocate on behalf of the industry with Project Owners provincially and regionally. Understanding the impact of non-standard clauses is important for all industry partners!

Workshop Structure

PUTTING YOUR UNDERSTANDING INTO PRACTICE! This Workshop is structured as an interactive exchange over the meaning and impact of non-standard clauses. This exchange will be followed by the participants responding to a tender containing a multitude of clauses and submitting a bid to the presenter who will analyze the bids and provide feedback.

Presenter: Kees Cusveller

A construction professional with more than 35 years of experience, Kees began his career as a project coordinator, moving his way through senior project management and into Corporate and Senior Management roles, providing leadership and direction to all operating groups and branches in the procurement and execution of non-traditional projects. With both a business and technical background, his leadership and innovative forward thinking has been responsible for strategic initiatives and alternative project delivery successes.

Facilitator: Debbie Hicks

With a comprehensive and varied education background, learning has been at the core of her career. As former President of the Southern Interior Construction Association in BC for 22 years, liaising with the buyers of construction services, architects, engineers and contractors in advocacy and education brings a solid base to her expertise. Through these experiences, Debbie is able to bring both knowledge and insight into her work and presentations for the construction industry.
