Description

As with any estate plan, there are events, and risks that may intervene to disrupt a well laid plan. Join us on Thursday February 21, 2019 where our guest speaker Paul Korpan of Kanuka Thuringer will examine those risks that arise from a legal marriage, or an equivalent to legal marriage, and where an estate plan may be at odds with the expectations of a spouse. He will review:

(a) The Family Property Act, and how the rights created by the Act may reduce the size of an estate, and/or eliminate assets available for distribution under an estate plan;

(b) The Dependants’ Relief Act, and the Court’s power to override the terms of a Will;

(c) The legal obligation to provide for one’s dependants, including children, in any estate plan;

(d) The rules regarding the division of gifts received before and during marriage, and the implications of making gifts to a beneficiary who is or who later may be in a marriage, or equivalent to married relationship; and

(e) The use of pre-nuptial or post-nuptial agreements to limit claims by a spouse, either upon marital breakdown or upon death.
