Seminar 2 (PM): What You Don't Know Can Really Hurt You: What Every Dentist Should Know About Employment Law - Mariana Bracic

This session covers the essential things every dentist should know about employment law in Canada. This seminar will guide you step-by-step through your rights and obligations regarding your employees. The last decade has seen a veritable explosion in litigation against employers, with skyrocketing damage awards. This course will help you learn important strategies to minimize the likelihood that you will be sued by one of your staff, and how to minimize your liability if you are.

Learning Objectives
By the end of this session, participants will be able to:

  • Describe common legal issues to be addressed when hiring and terminating staff.

  • Distinguish between an employee and what the law will treat as a true "independent contractor".

  • Describe the importance of a Discipline Policy and how it should be used.

  • Identify when non-competition agreements will be enforced, and when they will not.

  • Explain how the concept of constructive dismissal allows an employee to quit, yet be deemed by law to have been fired.

  • Identify and implement simple HR-law steps at every stage of your career to maximize the value and sale price of your practice.

Speaker Bio
Mariana Bracic began her legal career in 1994 at a prominent Bay Street law firm advising clients on employment law issues. Six years later, she became Advisory Counsel with the Law Society of Upper Canada, the regulator of all the lawyers in the province. In 2003, Ms Bracic opened MBC Legal, a boutique employment law firm and subsequently MBC Information Solutions Inc., a legal information company. Mariana received her honours degree in political science from the University of Toronto and then graduated from Queen's University Law School where she ranked first in her class in Constitutional Law, Civil Procedure and Remedies. She has also been entrusted with teaching tomorrow’s lawyers, having taught both Professional Responsibility and Civil Litigation at the Bar Admission Course.
