The Centre for Environmental Law & Global Sustainability (CELGS) at the Faculty of Law – Common Law Section is the University of Ottawa’s forum for research, teaching, discussion and advocacy related to environmental law and is home to one of the largest concentrations of environmental law professors of any law school in Canada. The Centre aims to promote policy-relevant environmental law research and teaching; encourage collaboration amongst faculty and students on research, teaching and community outreach relating to environmental law; and recruit, assist and train the best environmental law researchers and students.The Public Law Centre at the Faculty of Law – Common Law Section is Canada’s leading centre for public law research, debate and engagement, and home to the largest number of public law experts in the country. The Centre is bilingual, multijural and interdisciplinary. It brings together experts from inside the Faculty of Law and the University with domestic and international collaborators, visiting scholars, fellows and affiliated graduate students to create new opportunities for research and engagement across the spectrum of public law and public policy subjects.

Carbon Pricing at the Supreme Court of Canada – La tarification du carbone à la
Cour suprême du Canada

Professors from the University of Ottawa, Faculty of Law and counsel representing parties before the Supreme Court will share their perspectives and insights on the oral arguments made before the Court in the Carbon Pricing Reference. The Supreme Court of Canada (SCC) heard oral arguments concerning the constitutionality of the Greenhouse Gas Pollution Pricing Act (GGPPA) in the Carbon Pricing References from the Court of Appeals for Saskatchewan, Ontario, and Alberta on September 22-23, 2020.This Act was adopted in 2018 as part of the federal government’s plan to tackle climate change and established a national carbon pricing scheme. Decisions of the Courts of Appeal have been divided on the question of constitutionality; both the Ontario and Saskatchewan Courts of Appeal ruled the Act to be constitutional (4-1 and 3-2, respectively), while the Alberta Court of Appeal found the Act to be unconstitutional (4-1). The Carbon Pricing Reference represents one of most significant proceedings in Canadian environmental and constitutional law over the past decade and the Supreme Court’s decision on this matter will have major implications for both climate change policy and the division of powers in Canada going forward.Professors from the Faculty of Law directly involved in the litigation and counsel representing parties before the Supreme Court will discuss their perspectives on the presentations made before the Court, the key issues that the Court will consider in coming to a decision, and their thoughts on how the Court may ultimately decide the case. This moderated webinar will consist of brief presentations from each panellist, followed by a moderated panel discussion on potential implications of the case and a question and answer period._______________________________________________________________________________________Des professeur.e.s de la Faculté de droit de l’Université d’Ottawa et des avocat.e.s représentant des parties devant la Cour suprême partageront leurs points de vue et leurs réflexions sur les arguments oraux présentés devant la Cour dans le cadre du renvoi sur la tarification du carbone.À la suite du renvoi sur la tarification du carbone devant les Cours d’appel de la Saskatchewan, de l’Ontario et de l’Alberta, la Cour suprême du Canada (CSC) a entendu les 22 et 23 septembre 2020 les arguments des parties sur la constitutionnalité de la Loi sur la tarification de la pollution causée par les gaz à effet de serre (LTPGES).Cette loi a été adoptée par le Parlement fédéral en 2018 pour lutter contre le changement climatique en établissant une tarification nationale du carbone. Alors que les Cours d’appel de l’Ontario et de la Saskatchewan ont toutes deux jugé la loi comme étant constitutionnelle (respectivement 4-1 et 3-2), la Cour d’appel de l’Alberta a déterminé qu’elle était inconstitutionnelle (4-1). Le renvoi sur la tarification du carbone représente l’une des affaires les plus importantes du droit de l’environnement et du droit constitutionnel canadiens au cours de la dernière décennie et aura des implications majeures tant pour la politique en matière de changement climatique que pour le partage des compétences au Canada.Des professeur.e.s de la Faculté de droit impliqué.e.s dans le litige et des avocat.e.s représentant des parties devant la Cour suprême discuteront des présentations faites devant la Cour, des questions clés que la Cour prendra en considération pour parvenir à une décision, et de leurs réflexions sur la manière dont la Cour traitera l’affaire. Ce webinaire modéré consistera en de brèves présentations de chaque intervenant.e, suivies d’une discussion sur les implications potentielles de l’affaire et d’une période de questions et réponses.
